After Australia, where the Galaxy Tab should return to the Australian market by the end of the week, Samsung won a new round in the U.S. court. District Court of California has decided to reject the application for an injunction prohibiting the sale of Samsung devices across the Atlantic for, as always, patent infringement. Judge Lucy Koh, handling the matter, did consider that the design of smartphones between South Korea was very similar to that of the iPhone, but this did not constitute irreparable harm, as detailed in The Verge site.
Samsung will be able to sell its mass Galaxy Tab tablets and especially its smartphone Galaxy S II, in this key period of the holiday season. Samsung has welcomed the decision, which welcomed them in a statement: "This decision confirms, as we have long argued that Apple's arguments lack validity."
Samsung and Apple will face next year in a trial on the merits of the case. At this time we will know whether or not there was patent infringement and any damages will be claimed.
